What a problem they did not visualize about the National Transparency Platform in the constitutional reform. The National Transparency Platform (PNT) is the main tool in Mexico to exercise the rights of access to information and protection of personal data through requests for Access, Rectification, Cancellation and Opposition.
Through its 4 modules, it allows to interact, consult, request and present disagreements about the information generated by the country's public institutions. It is the bridge between citizens and the agencies that receive public resources.
It has 11 search engines that are search engines that allow queries to be made in less than a minute by specific topics such as: salaries, directory, procedures, services, budget, contracts, among others. The results are classified in a simple way, displaying the information on the user's screen.
The PNT has been implemented and updated over the years, with state-of-the-art technology in both its infrastructure and its development.
It has an open data section where you can download all public information currently hosted by the PNT in open formats for use and analysis by the general public.
Integrates the application of a tool that enables accessibility features for people with different types of disabilities.
It includes a statistics section where you can consult graphically the daily information on the number of requests, complaints and resolutions filed. The statistics are available for all obligated subjects and you can select the information to be presented by sector (Executive Branch, Legislative Branch, Judicial Branch, Autonomous Bodies, Political Parties, Unions, City Councils, etc.). This is a proactive transparency action, information available to citizens.
Specialized technical personnel are required for its operation, maintenance and updating. Approximately 45 people specialized in different branches of information technology and communications have been involved in these activities.
But does the PNT belong to the Executive or to the Mexicans? Let me explain, according to the ruling approved by the Constitutional Points Commission of the Chamber of Deputies, published on November 6, 2024 in the Parliamentary Gazette, in which the extinction of INAI is proposed, the protection of the rights of access to public information and personal data protection is divided into the internal control and surveillance authorities of the obligated subjects, which substantially changes the way in which the associated processes and procedures are carried out; And there is no authority established in the three branches of government to regulate the requests, complaints and transparency obligations that are currently managed in the PNT with respect to unions, autonomous agencies, universities, the Executive Branch, the Legislative Branch, the Judicial Branch, political parties or municipalities.
Given that it radically changes the structure of management and protection of the rights of access to information, the design of the current PNT is not compatible with the provisions proposed to be approved at the constitutional level.
Likewise, it has been proposed that the new Anti-Corruption and Good Governance Secretariat (formerly the Public Function Secretariat) should absorb INAI's functions. Under this precept, the PNT contains a management structure at the national level and based on collegiate bodies, both at the federal and state levels. This is not in line with the structure of a State Secretariat, which does not have collegiate resolution instances; therefore, a new system would have to be developed to meet the new provisions, based on the competencies of that Secretariat.
The PNT administers and manages the information of 7,407 regulated entities, of which 6,684 are state and only 723 are federal, according to the latest update of September 23 of the list of federally regulated entities. Of the latter, only 270 correspond to the Federal Executive Branch. This means that, instead of having a single window, the right to information is dispersed in more than 7 thousand windows with different capacities, formats and criteria, according to the resources, capacities, infrastructure and IT structure of each compelled subject.
There are currently 14,958 million 354,495 records loaded in the PNT, how many are from the Executive Branch? There are only 1,931 million 837,862 and 12,571 million 184,725 from the States. INAI has invested the necessary resources in infrastructure and security to maintain the records and the operation of the PNT in a secure and continuous manner. Under the new constitutional proposal, each obligated subject and/or competent authority would have to invest in the development of systems, infrastructure and security to guarantee and protect rights, based on the rules to be approved.
So far in 2024, 272 million 339 thousand 021 cyber-attack attempts have been registered. On average, 24 million 758 thousand 092 attempts are blocked per month, thanks to the perimeter security service contracted by INAI, whose contract is open for a minimum amount of $6 million 856 thousand 619 and a maximum of $17 million 141 thousand 548.
In Mexico, the PNT has succeeded in bringing together all public institutions, called obligated subjects, to make transparent and disseminate the information they generate.
The adoption of technology in the right of access to information has increased the quality of services and streamlined procedures, in addition to making it possible to request information online at the national and international level.
The PNT has inspired and promoted important journalistic research studies in which success stories against corruption are narrated. It represents one of the most important technological advances in terms of transparency and access to information, not only in Mexico, but is recognized internationally.
In a globalized world, the use of Information Technologies is indispensable for the extensive and intensive dissemination of the exercise of the right of access to information and protection of personal data.
So: the National Transparency Platform should be housed in a university or civil association for the sake of the rights of Mexicans.
